Tenant Woes
I have had very strong recurring odors in my womens dress shop during the summers. It has been determined that it is coming from an unoccupied unit adjacent, and the landlord will not maintain it to prevent the odors as instructed by plumbers 2 years ago. I have lost business as well as merchandise with odors settled in. After strongly urging the landlord to repair once and for all and giving him a statement of losses of 3, 300.00 he sent me a note to vacate in 5 days citing non payment for this month when he has not come to collect it yet. Without knowing this, I sent him a certified copy of list along with this months rent a day earlier. They have not been present to receive the mail on attempts by postman. What are my rights? Do I have to abide by this note that he left at my store with my employee. I have signatures of individuals who found the odor to be unbearable and could not do business with me as well as other suitemates who are willing to testify of my dilemma. What should I do?

You can either relocate and hope for a better landlord or try to litigate this. Even if you win, you'll have a continuing problem with the landlord, who would look for/again fabricate an excuse to make problems for you.
