Legal Question in Real Estate Law in Louisiana

Timber Sale on Undivided Property

I purchased from a family member an interest in undivided property. We want to sell the timber but 1 aunt does not want to sell. She owns 1/4 of the total and everyone else is ready to sell the timber. Can we sell all the timber or would we have to leave 1/4 of the timber uncut?

Re: Timber Sale on Undivided Property

You cannot sell the timber without her consent or a court order. She owns 1/4 of all of the property, not an interest that can be cut up. In other words, she owns 1/4 of each tree cut down. You and the other heirs can ask the court to allow the cutting and selling of the timber. If the court won't let you do that, then you may have to sell the property altogether.
