Legal Question in Real Estate Law in Louisiana
Timeshare maintenance fees
My stepfather and mother purchased a time share in New Orleans, which is now completely paid for. My stepfather passed away a year ago and my mother is getting threatning letters from the timeshare collection agency to pay for the maintenance fees. How can she get released from this contract?

Re: Timeshare maintenance fees
If the time share is paid for, there should be value/equity in that interest. Thus, you need to find someone who wants the time share and will pay your mother for that interest. A time share can be traded for use in another location. There are a number of places where you can sell a time share interest, but the maintenance fees will have to be paid. I don't know if this time share is actually deeded real estate or one of those contracts where you buy points. That would affect the value of the interest as well as what are your rights in the event that the maintenance is not paid. You should get legal counsel to find out what the agreement says and what are your rights.
