When you own a tract of land 17.5 acres and another party owns, through inheritance, 1 acre, can you make use of your parcel even though the land has not been divided up legally?

I am not sure what you are asking. When the person inherited the 1 acre, the acre they are inheriting should have been discribed precisely. If what you are saying they they inherited 6%, then that person owes 6% of the whole and not 1 acre.
