does a widow have to open succession on a property owned by herself and her late husband, if they have children?

The succession does not have to be opened unless the property is going to be sold or transferred. The surviving spouse has life. Usufruct of community property,

In order to put 3rd parties on notice that the property is owned by someone other than what the public records reveal, then it should be opened. Sooner or later it will have to be opened, whether it is now or after you die. If they wait until after you die, then 2 successions, usually combined into one filing, will have to be opened.
