Legal Question in Sexual Harassment in Louisiana
Unfair Practice
I was working a security Manager for a Contract Security Company at a Chemical Plant. A week ago my Branch Manager walked into my office and told me that I was being suspended pending investigation of a sexual harassment complain. I was asked to write a statement, but i was not given a timeframe as to when this was to have happened, no details what so ever. After writing my statement,I was told that I was going to be released. No one questioned me,asked me any question concerning the complain. I did not committ any such acts, what are my rights.

If someone lied about you that resulted in your termination, then you have a cause of action against the liar.....if you can prove that someone acting on behalf of the company participated in the activity that led to your termination, there could be liability on the part of the company.....

Unfortunately, because you are probably employed at will, there is not much you can do. An employer can terminate an employee for any reason (even if they are wrong about the reason), as long as it is not discriminatory. If you could show that you were released for some other reason, i.e., the reason given for your termination was just a pretext for terminating you because of your race, sex, etc. or if you can show you were terminated in retaliation for exercising some kind of right, then you might have a cause of action against your employer. Of course, if you have an employment contract, the contract controls how and when and if you can be terminated. Good luck.
