As a divorcee's spouse who died

My spouse and I were married for approximately 27 years. He passed away this year and I have never remarried. Can I draw Social Security benefits from him?

Dear LawGuru Friend,

Sorry about the passing of your long-time spouse! Yes, my opinion is that you can. However, it's like I tell many of my clients who inquire about whether they can get Social Security beneifts; and that is that nobody ever received Social Security benefits that did not apply for them, or at least that someone did not apply for them on their behalf, such as for a child. Good luck! Go ahead and make application! Now that is even done by phone. You do not even have to fill out forms any more. Good luck!
