Legal Question in Social Security Law in Louisiana

minors who receieve survivor benefits

my niece is 17 years old. her father passed away and she is receiving her fathers benefits.

she recently left home to live with my mother, her grandmother. (history of physical and mental abuse, as well as total mistreatment and neglect)

her mother is blowing through her benefits .. what or how can she get the check (direct deposit) to come directly to her?

does she have to become emancipated?

we are so confused and do not even know where to start!!

any advice would be helpful.

thank you so much...

Re: minors who receieve survivor benefits

Either emancipate her or wait until she turns 18 and then she can start receiving the benefits. At that time you ask the mother for an accounting.
