accident w/ parked abandoned vehicle -- who is at fault?

Had a accident where a car was abandoned and left 4 feet in the middle of the road. No ticket was issued. The speed limit on the street os 35 mph. My insurance company said that it appeared to be my fault. I hit the vehicle on the rear side panel. My vehicle is probally total loss. 1999 dodge dakota, only have liability on this vehicle. Thanks

The problem is that no matter if the vehicle was in the middle of the street, you should have seen it. And since you were the one moving you had the greater duty to be on the lookout. This will be a tough one to win, but you must show a reason the abandoned vehicle was at fault.
