Legal Question in Traffic Law in Louisiana

What can I get?

This morning I was in a wreck. I was stopped at a red light when I was rear ended. I was hit pretty hard but it didnt hurt the car to to bad. I went the the E.R. and was checked out and released later on with some meds scrips. I also had a passenger in the car with me also and he was checked out to with the same results! Well while I was waiting in the E.R. the guys insurance co. came and took pics of the car and tried to settle with me right there for the car and pain and suffering, but did not disclose a figure. Just out of curiosity what would a case like this recieve money wise. Just to add a little note but this same guy hit my dad and sister in janurary and they were pretty messed up pretty bad, and they recieved approx. 100,000$ each and to my knowledge he has 100,000 300,000 100,000 is what is coverage he had at that time with no umbrella. so what do you think that i could get money for pain and suffering???

This would depend upon your injuries, your medical expenses, your lost wages, and any future disability and future lost earning capacity. Moreover, there is a probable range based upon prior cases, but no set formula. No one can tell you this from the information given by you, particularly at this early stage. Your recovery could also be reduced on a percentage basis by your percentage of liability, if any. This might include factors such as failing to wear a seatbelt.

You should not quickly settle with an insurer, as you do not know the extent of your injuries at an early stage.

Yes you can get damages including pain and suffering. If you were released from the hospital already it should be substantially less than your relatives received.

How much it is worth depends on too many factors to predict on available information. Do not settle without consulting an attorney. You don't even know how hurt you are at this point. You probably will feel worse in two days than you do right now. The next document that you sign should be a contract with a lawyer.
