With no will, children inherit deceased parent's interest in home.

Children own their parent's property after he dies without a will. If he had separate property, then they own it all. If he had community property, then they own his 1/2 subject to the suviving spouse's use of the property. If the other spouse wants to sell anything that someone else is part owner of, then have to get all owners' signatures. If the co-owners refuse to sell, then the spouse can Petition the court to sell it.
