This is a guess, but it seems if the first one is valid, then the second one is without affect. However, should the parties want to divorce, then they may have to do it twice.

The first marriage is valid. The second marriage was invalid and was actually a technical violation of the law. Technically, you both lied on your second marriage application when you stated that you were not married at the time you applied for that "second" marriage. You were already married--to each other.

I don't think it could be any serious offense (as you were not attempting to enter into a bigamous marriage), but the second marriage is null and void from the outset.

You should probably contact the Office of Vital Records in the second state and inform them of your previous marriage. They will probably want to see a copy of the marriage license from the first state (it may help to get copies of both states' licenses). The Office of Vital Records in the second state may just cancel the second marriage license once they see the first. They may require you to file a suit in their state courts to annul the second marriage. I think you should do whatever you have to do, because what you have now is a mess.

I would not recommend doing nothing. I think you should clear up the issue now.

You can get copies of your licenses online quickly at a website called VitalChek. They are online at www.vitalchek.com. I used them to get my marriage license and birth certificates.
