Legal Question in Wills and Trusts in Louisiana
deceased dad listed in will
I am 25 years old and my sister is 20. We are the only heirs to my Dad who is deceased, but listed in his parents will (my grandparents). He was to have received the family home and 27 acres of property. He has two living sisters. One lives on her property that is listed in the will as hers. The other lost her portion of the property in a bankruptcy and moved herself and her family into the family home with her parents 23 years ago.
My grandfather is deceased and my grandmother just passed away. The will remains the same as it was made 22 years ago, with my Dad to receive the home and 27 acres. The aunt living in the home seems to think she will be able to just continue living there with her family. I do not know if there is a executor to the will. Who makes the first step? My grandmother told me it was to go to me and my sister. I don't won't to cause any problems in the family but think my sister and I are entitled to my Dad's portion of the inheritance. Any suggestions as to what we should do, because I think the aunts (my dad's sisters) are happy with the way things are. I know the one living in the house has no plans to leave. Also the attorney who drew up the will is deceased if that makes any difference.

Re: deceased dad listed in will
Get the will and take it to an attorney. Let the lawyer reading it tell you what should happen. Normally you would inherit your father's portion.
