Decedants home was appraised for 155,000, but the motgage is 153,000, can we file a "Small Succession?" There is no will and other property is valued at a 5,000. There is only one heir. No community property.

A small succession is defined as one haveing less than $50 k GROSS value.
The onlt difference is in the court costs: a small succession is less.
