Legal Question in Wills and Trusts in Louisiana
Am I really disinherited?
There was an original will with my name on it for more than 30-40 years as the legal heir to my Aunt's Estate because she considered me to be her daughter. My Aunt became terminally ill with lung cancer and had only six months to live and my cousin took her in. She had to breathe on an oxygen tank or she would otherwise become disoriented. Her memory would waiver in and out. I live in California. During the 7 months that she lived with my cousin the will was rewritten and my name was totally removed. All of my Aunt's bank accounts were closed and placed in my cousin's account. My cousin says that he was given a verbal power of attorney by the living brother and sister of my Aunt. And now that she has died and the will has been changed he was named as 100% heir to the house, cars, boat and all monies left by my Aunt. He is not telling relatives about any of the details of the will, except that he is 100% heir and my Aunts Estate and will not talk to relatives. Can he do this? Should we be able to see the will and what ever papers he says my Aunt signed giving him 100% of her Estate? Am I really disinherited? Can I contest this recent change of the will when I know I was originally name on the will? What can I do?

I concur with the other responses, there are strategies available to contest the will. As you stated, this is a will, and thus are public proceedings. A copy of the will is available once a probate is opened.

This situation is quite common. You need an attorney to demand a copy of the will and other documents. If what you are told is true, you are going to have to file a will contest.
