Legal Question in Wills and Trusts in Louisiana

Divorced Father of 3 minor children recently died without a will. Who should open probate?

Just for correctness, if there is no will there is nothing to probate. Assuming Louisiana law applies, without a will his children would inherit everything. Therefore whomever has custody of the children would open the succession.
