Executor moved into family house
My father died 6 months ago. My brother is Executor. The succession was done quickly. He let my father's house sit empty while he sold his home and moved into our father's home, without asking. He took first choice of all of the personal property and didn't provide any type of inventory to the rest of us (4 others). I don't know if that is required. He placed the house for sale for almost $100,000 more than its worth so that it won't sell and he can continue living there rent free, yet still staying within the boundaries of Executor (technically, the house is for sale). We have been told by him that the sale of the house and the financials of the estate account are none of our business. We are equal beneficiaries. What are our chances of having him removed for living in the house rent-free without asking anyone? Can he do this? Can he not disclose the financials?

Re: Executor moved into family house
Go see an attorney immediately. Unless your father's will granted your brother the right to live in the house, he is not entitled to do so. The executor of an estate is a fiduciary and should not be acting solely to benefit himself.
