Legal Question in Wills and Trusts in Louisiana
My father passed away December 25, 2010. He left a living will, which left everything to his children. He is married, but has not been with his wife in over 15 yrs. She lives in Alabama, and has never lived with him in Louisiana. Can she come take what he left to his children?

Yes. If he is married, 1/2 of everything he earned and everything he purchased during the marriage is community property and she owns 1/2 of it in her own right. Even if he left her nothing, she is entitled to her 1/2 as owner if they were married.
