Legal Question in Wills and Trusts in Louisiana
My grandmother died Christmas of 2009. There has, to this day, been no reading of her will. My uncle is in charge of her estate and refuses to talk to us, save for curtly responding only after having to respond to a legal letter from my mother.
My grandmother's money was to be split a quarter to my mother, quarter to my uncle, and the rest was to be divided equally among the grandchildren. I would have received roughly $15,000. In the letter he sent to my mother he states that we harass him and threaten him and that we should not mention money because he is still paying on both funeral home bills (grandmother was prepared in Houston, TX and then flown to Bonner Springs, KS). Both of these statements are untrue. We have not been able to contact him save for the single letter in which no harassing statements were made. We also have both of the funeral home's bills which state "Paid in Full" which raises quite a few eyebrows and assures us he is squirreling away money for himself.
My mother will do nothing further and will not give me the trust fund papers. I need to find out how I can get my inheritance and the trust fund papers. I am self-employed so I cannot afford a lawyer.
1 Answer from Attorneys
Without a lawyer, you won't be able to do much. You need to open the succession, but you won't be able to do that without an attorney who understands Louisiana succession law.
