it's a La will that my brother had written by an atty prior to his death; what does this wording mean: I do name and appoint (name of person-Mary) as executrix of my estate with full seizin and without bond. In the event (name of person-Mary) is unable or unwilling to serve as executrix, then I name and appoint (name of person-John) as the executor of my estate; and would this apply to a lawsuit that was filed after his death?

A lawsuit filed after your brother's death would have to be filed by the Executor of the decedent's estate. If the suit were filed against your brother, then his estate would be the defendant, and the Executor would represent his estate in the lawsuit.
