Legal Question in Wills and Trusts in Louisiana

Name used in Legal Affadavit without Permission

My half sister named me in a legal affadavit for secession of my decedent father's estate without my permission. The affadavit includes my SSN that I did not give to her or the Lawyer that composed the affadavit. What can I do to her and the lawyer? Can I sue them for violating my privacy?

It is not often that a person complains because someone stated that they are entitled to property.

In the affidavits relating to your father's succession all of his children must be identified. She and her lawyer had no choice. If they had not mentioned you as a child of your late father it would probably mean that they were trying to cheat you out of your share. You would have the right to contest the succession. I don't think this "invasion of privacy" will be considered seriously by the court.

In the alternative to Atty. Casanave's response, because I am not quite sure it is clear in your question, perhaps you were named as an alternative executor?

If this is the case, then there really is nothing to worry about, just don't accept if and when your duties are needed.

Maybe a little better explanation of the situation would help. Please feel free to contact me at 626-578-0708 or online at our firm's site www.No-Probate.com.
