Legal Question in Wills and Trusts in Louisiana

Sale of Mobile Home

Both of our parents are deceased and the family wants to give power of attorney to one brother to sale my parents mobile home only and received the funds from the sale. Do we have to do a succession if none of the family members object to my brother receiving the power of attorney to sale my parents home??? If noone but my brother will receive the money from the sale of the motor home. Do the rest of the family have to give their social security numbers for a succession?

Re: Sale of Mobile Home

The DOT has a form for an Affidavit of Heirship that you can obtain & complete & return. Good Luck.

Re: Sale of Mobile Home

I am assuming that you are not tranferring any land, just the mobile home. Check with your local DMV office. I believe they will want some evidence to transfer title from your parents to you and your siblings, but you may be able to get it done with an affidavit of death and heirship and a death certificate instead of a full succession proceeding. The power of attorney is probably not a problem, but right now title to the mobile home is still in your parent's name and you need to transfer title to you and your siblings before you can give power of attorney to your brother to sell it.
