Sister refuses to cooperate, sale of mother's home
My mother died in September of 98. My sister refuses to cooperate in the selling of the home my mother lived in for 11 years. The house is appraised at a certain amount and she refuses to go down to the amount it was appraised at. She wants to sell the house for 11,000 dollars more than it is appraised at. the home is empty and uninsured and I fear we will lose it to fire. It has already been vandalized. What can be done about this situation? What are my legal rights to protect myself and my assets?

This is only a general reply and you should consult your attorney. A partition may be sued for by any heris or legatees under Louisiana Civil Code Art. 1307, et seq. Partitions can be sued for by each heir, or co-owner, so that one heir alone can force all the rest to a partition at his instance.
