My spouse died Jan '08. I plan on getting remarried this year do I need to open succession?

Not specifically to get remarried, no. All you need to do to get remarried is to show a copy of the death certificate when you go to get your new license. However, sooner or later, you will probably have to open your dead spouse's estate, as he (or she) certainly had property in his (or her) name and you and the other heirs need to be placed into legal possession of that property.
