If someone took money belonging to a minor, the minor's legal guardian can sue to recover the money on the minor's behalf. Usually, that is the minor's father. If the mother has legal custody of the minor, she can sue. Anyone can sue on behalf of the minor if the amount sued for is less than...I THINK the amount is $7,500.00. It may be a little more, like $10,000.00.

In any event, the short answer is that, unless you are the child's legal guardian, you would not be the person to sue on his behalf in most instances.
