Legal Question in Wills and Trusts in Louisiana

tutorship gone bad

WEll my mom was an undertutor for a minors money. My aunt was the tutor. My mom only signed a paper at attorneys office,my aunt took the check to bank and my mom went home. Now about 6 years later, the money has dissappeared. My mom had no knowledge of anything and is being brought to court along with my aunt as partially respionsible. Also she was told by tutorship attorney upon signing that it was just in case my aunt was deceased or something that my mom would take over. Please give me any advice you can to help my mom.She seems to not be concerned she maintains her innocence will get her through it,but im concerned because the jail system is full of innocent people who couldnt afford attorneys.

Dear LawGuru Friend,

Frankly, I do not think your mom has anything to worry about. She performed only a perfunctory action; and I do not see where she is responsible, since it was the tutrix that mishandled the money. Your mom will easily be able to prove that as an under-tutrix she never handled any money. Best of luck to you and her!

Sincerely,

I really suggest that you have her consult an attorney.
