Legal Question in Wills and Trusts in Louisiana
A Will
My step father passed away a year ago He named his wife and my two half sisters in his will. my sisters sisters are fighting the will and have it tyed up with lawers for the past 12 months. Now my full brother wants to protest the whole will because he was not named in it. He wants me to join the fight I say it won't change a thing. What are the chances of us getting part of the estate?

Dear LawGuru Friend,
My answer is that you and your brother as "step-children" to the decedent (your step-father) cannot be "forced heirs"; so that are are automatically entited to a portion of the decedent's estate, no matter what his will says or does not say. As I understand the law, step children are not forced heirs. Incidentally, a forced heir cannot be more than twenty-three years of age at the time of the passing of the decedent. There is more to it all than this, but this is something to think about. Good luck!
