Legal Question in Workers Comp in Louisiana

My husband was injured offshore. They were taking scaffolding off a jacket leg. The platform had been removed 3 days prior. His main quarters and job were on a barge. Would this fall under the Jones Act since there was no platform there and he was operating from a vessel? It's been 2 months, he has not received anything from workers com as far as pay or approval to see his doctor of choice. Workers comp keeps saying they have to determine if it is long-shore or Jones act.

You need to hire an Attorney well versed in the Jones Act and Longshoreman Harbor Workers Act who can assist you. If you have paid an Attorney then ask him. If you hired an Attorney without the proper experience, find another one. WC will keep telling you to have your husband classified so the correct laws are applied.
