Legal Question in Workers Comp in Louisiana

I work for the lafayette parish school board for 16 yrs in a high school special ed. class. I was injured on 03/05/08 due to a fall, a special ed. student tripped me. I fell so hard that I injured my neck, shoulder, back and broke my right arm. Also have head pain that has never went away from the moment of the fall. I have done everything that work comp has tried through the Dr's. from Months of PT before and after my neck surgery on Oct 3, 2009. I am now in more pain after the surgery. Also lost most of neck movement and arm strenth. Cannot lift more than a gallon of milk or lift arms over head. Quality of live is very low. Now workers comp wants me to go back to work in another line of work like gas station attendent no benifets and if I do I will lose all my school benifets. I have never stopped paying my health ins,disability ins,( which school board refuses to file for me) dental ins and retirement. Also I have not, nor will not resigned from my job. I have not been let go either. One of the Dr. said I can try to go back to light duty under conditions but school board said they have no light duty. I understand I can not go back to my postion as a special ed asst.to the handicaped, but I may be able to do other things. I'm still under Dr.s care and on meds which he now has said the pain may never go away and may need future surgery. What are my rights when it comes to workers comp.

You need to hire a worker's compensation attorney. It may that you can settle the disability claim and the attorney can file whatever is possible with your disability insurance. If you are released for light duty but the employer cannot offer a position, they should be ready to settle the matter.
