Legal Question in Workers Comp in Louisiana

no worker's comp?

I was injured on the job. I woke up in the hospital. My liver had been sliced in half and had a crushed lung. The Doctors said they almost lost me several times. When I went back to the hospital for the first follow up I found out my employer had no woker's compensation. Called my employer, they said that worker's compensation insurance had expired 6 days before I was injured. I have no idea what problems I might face later on in life with my injuries. Am I entitled to any kind of settlement? They are paying me some money weekly and I applied for free care. I have nothing in writing saying how long they plan on paying.

Any advice would be very much appreciated !!!

If you were injuried on the job and there was no outside influence that contributed to the injury, then it appears you are only entitled to workers compensation benefits. You should be receiving 2/3's of your average weekly wage, plus ALL medical expenses. If your employer had no WC insurance, then he is personally responsible for payment of those benefits. Any settlement would be something to consider when you have reached maximum medical cure. You can report the employer to the state if he had no insurance AND is not paying you the full benefits you are entitled to.
