Legal Question in Workers Comp in Louisiana
My workplace injury was jan 2007. I have been on seb for over 4 years. The insurance company is now trying to disprove my injury as a workplace injury. Louisiana law states personal injury suits have a 1 year statue of limitations. Do I have to deal with this and should the work comp court allow their action to enter court as they must follow La. law?

The prescriptive period is one year. However, you have an excellent argument that the deadline should be extended in your case to one year after you discovered that it may not have been an injury covered by worker's comp. You should talk to a local personal injury attorney in your area immediately.
