What does one need to do to ask the opinion of a court without actually going to trial?

What you seem to be asking for is an "advisory" opinion--asking the Court to tell you if what you want to do will be OK. Courts in the US do not do this. Our system is designed so that before the Courts will opine there must be a true dispute between the parties. If you are not asking for advice, then you may be asking if the court will rule *before* a trial. That is an entirely different question but it still requires that there be parties who are at odds with each other.
