Legal Question in Bankruptcy in Maine
Please Help! -- co-signer problem
I am in the process of filing for bankruptcy without an
attorney. I recently discovered that because one of my
student loans was made by a private institution, it is a
dischargeable debt. I do not want the loan to be
discharged because there is a co-signer, and I do not
want her to be held responsible for the debt. Can I
reaffirm the loan in the same way I would a secured
debt?
Please help!!!

Yes. Creditors enjoy debtors who wish to reaffirm debts especially those that are dischargeable. You or an attorney should contact the institution. I would not simply roll over. Since the creditor knows the debt is dischargeable you may be able to get a reduced amount and/or reduced interest when you enter into the reaffirmation agreement. ph (800) 303-0720
