Meeting of creditors-1 month ago-just recd notice of possible class action
Just received a notice of a possible class action which I can opt in or not. I had my meeting of creditors over 1 month ago. If I opt in, they are indicating the suit will not be heard until mid-2009, can my discharge be held up til then? Should I opt out? Will this have to cost me more money to add to my bankruptcy paperwork in addition to additional attorney hours and work?

Generally, you must keep your bankruptcy paperwork updated with any expected lawsuit or settlement benefits. Whether or not you should opt out would depend on a number of factors, including what the likelihood is that you would receive any benefit and what that benefit would be. There is a $26 fee in Maine Bankruptcy Court to amend your schedules, but that fee can be waived for good cause. In order to know if it would cost you additional attorneys fees, you would have to look at your fee agreement with your attorney.
