Legal Question in Bankruptcy in Maine
Responsibility of credit card debt transfer
During a recently dissolved 3 yr. relationship, my then fiance transferred the balance of my credit card at his insistence to his card, whcih had a lower rate. My name was never on his card. I did pay the monthly bill. When he left my home he forged my name on a document stating that I would pay him for the transferred debt. Because of his harrassment of myself and family, and a suit for endue enrichment (I could not afford legal represen. and was under to much stress) I agreed to a settelement. Now, because of needing to help my oldest child with medical coverage as she is no longer covered by my insurance (age), I cannot pay on that settlement (100 per month). Should I let him take me back to court and then refute the forged signature? I have told him that I am faced with family medical pressures, with no response. Where to go from here? Can I represent myself?

Undue enrichment problem
You may have some problems bringing in the evidence of forgery and I recommend you get representation. You will need help and may ultimately need to consult with an attorney about bankruptcy.
If we have not met face to face and agreed to my representation of you in a written agreement signed by both you and I, then I am not your lawyer. Any comments made here are not legal advice but presented in the spirit of this bulletin board as general information only.
