Legal Question in Business Law in Maine

I would like to bring a food product to market. This particular product can be found on many websites where it's referred to as the same name. I have used my limited resources and it looks like there is no trademark for this product, and more importantly it doesn't already exist. We have a very limited budget and would like to know if this product is already spoken for on the market before we invest more time or money. Are there any resources where we can get this research done at no cost, or very cheaply? Thank you for any help that can be offered!

As a Franchise Attorney I think you are confusing legal concepts. A food product in general is not protected unless it is subject to a patent. A trademark is a unique brand that is applied to goods, like food, watches, purses, etc. It sounds like you need to come up with a brand that can be trademarked. Consult with a good business or franchise attorney in your area for specific advice.
