non compete agreement
When I started with my company as a job developer, I soon became a director for my office my supervisor had me sign the non compete agreement. Since then I have resigned as director and am back as a developer which they do not have to sign this agreement I want to leave and persue a LLC in the same field no employees but myself and only doing it part time. Can they stop me legally? The main office is in NH not maine. It states I have to wait 1yr after I leave before I can start on my own. Is there a way around this? I will not be any competition for them they are in 5 other states and have over 300 employees. I need to leave soon to help my family.

This is not something that I can give you specific advice on over the internet. It is very fact-specific. I would need to review the non-complete you signed, and I would need to learn more about the circumstances surrounding the signing and about the company. Non Competes are enforceable, but there must be consideration given by the employer for them. They are enforceable only to the extent they are reasonable in time and distance, which cannot be answered in the abstract. There is certainly the possibility that this one would not prevent you from going out on your own.
