Legal Question in Business Law in Maine
Revocation of limited power of attorney and notorized releases?
I own a business that has a shared mortgage with my ex-husband with our old house attached as collateral. I had given him a limited power of attorney to run the business and signed a release with him saying that I was free of all debts attached to the building and also signed a property release and had them both notorized. He has become extremely angry over something I made poor judgement on in my personal life and is now threatening to make my life miserable. How can I revoke these documents? How do I get my name off of these mortgages? The FIN and Sales Tax information are all in my name. All the vendors, insurances, business partners have my name on the bills to the business. I need to know how to get out of this. Please keep in mind, we have one child together and my oldest daughter, his step-daughter live with him while I am out of state at the moment. Please help!

Re: Revocation of limited power of attorney and notorized releases?
I am unclear from your question if these documents were all part of a larger written agreement between you to manage your affairs? part of a divorce judgment? etc? A POA can be revoked by notifying the holder of the power. However, you cannot take your name off a mortgage unless the mortgage is refinanced solely by the other party. It sounds like there may be other ways to resolve the solution, feel free to call and myself or another lawyer at my firm can help. Thanks-
