Legal Question in Business Law in Maine
Unauthorized charges to check card
Can a company who makes unauthorized charges to my check card / debit card be sued by me for damages?
After having some unauthorized charges deplete my business bank account below zero I lost use of my funds for several days making business difficult. Is there any action that an individual such as myself can take to recover losses from the merchants who caused this problem by making unauthorized charges?
My funds were regained days later by disputing these cahrges but that does make up for the inability to utilize those funds for several days.

Re: Unauthorized charges to check card
In theory, yes, unauthorized charges that caused damage to you can be the subject of a suit to recover those damages. However, the issue is how much are the damages as a cost-benefit analysis. There is no ability to recover for mental anguish, etc except in rare circumstances.
