Legal Question in Business Law in Maine
Working under non-current contract
I have a 2 year non-compete clause in my contract as a healthcare provider. My written contract ended in July 2003, but I have been working just the same without a current contract. Am I still under any obligation to the non-compete since my contract ended in 2003, or am I still ''under'' contract since I simply continued working? Thanks

Re: Working under non-current contract
The language of the contract would, of course, need to be reviewed carefully as it may provide that the terms of the contract continue as long as employment continues, etc.- That might be the basis for you continuing to receive benefits and salary consistent with the old contract, so you could be held to the old contract's requirements as well.
On the other hand, if the language is ambiguous on that point, non-compete provisions are construed as narrowly as possible by the Court.
