Legal Question in Constitutional Law in Maine
Because Attorney General Beau Biden has done nothing about all the requests for the revoking of the Corporate Charters of Corrupt Corporations such as BP America, Can action be taken against the State of Maine? (the state in which they were incorporated)
1 Answer from Attorneys
Beau Biden is the Attorney General of Delaware. He has no authority to revoke charters from other states. And I doubt he has that authority even in Delaware, except (perhaps) where the company fails to pay its registration fees or meet other requirements. Even then, the authority probably belongs to the Secretary of State.
I don't know why you believe BP America is corrupt, or why such corruption might justify revoking its charter. If it has violated laws that justify the type of penalty you seek, that decision would probably have to be made by a court rather than by a member of the executive branch.
There are several different entities that collectively make up BP America. I don't know if any of them are incorporated in Maine. But what I wrote above is likely true in most states.
