Legal Question in Credit and Debt Law in Maine

Burned by magazine

I worked for N'East Magazine in

different capacities since 2006. The

publisher owes me over $5,000. I let

him slide on late payments because I

believed in the magazine (he claims

we had 2,500 subscribers.)

There is a much longer story here,

but he may declare bankruptcy.

My question is this - if there are

enough advertisers, writers, artists,

editors, and photographers who are

owed money, can we all file one case

in small claims court.

In Maine, the Small Claims limit is $4,500, so probably even just your claim by itself cannot be brought in that Court. You also cannot agree to limit your claim to $4,500 if it is larger, just to be in Small Claims.

Obviously the cost/benefit needs to be carefully reviewed if Bankruptcy is a serious possibility.
