Legal Question in Credit and Debt Law in Maine

Husband died, I'm in big debt

My husband and I lived in Maine. We seperated. He refused to pay any bills on a home, 2 cars, 2 credit cards and some other loans, all that I had cosigned on, but didn't understand any of it, I was 19. I did my best to pay the bills, I had a full time job, but I also had 2 kids and wound up losing it all. After losing it, I still tried to pay the bills but had gotten laid off from my job. He died after we had seperated and just one month after he quit a job where he had life insurance. Therefore I was left with no way to pay the huge bills. Am I still responsible or is there a law that would relieve the stress from me?

Re: Husband died, I'm in big debt

As an initial matter, it appears as though you now reside in MN, not ME. Do you still have any real estate located in ME? If not, the fact that much of your debt may have originally been incurred when you lived in ME does not mean that it is the State that you must deal with the problems in. If the debts are now all for autos, credit cards, and not real estate you can have MN counsel help you to address the problems.

Although you refer to being separated, I am not clear if you were actually divorced. Do you have a Divorce Judgment that assigns the debt to your ex-husband, and therefore his estate? Are there any assets in his estate?

The only law that will help you erase the debt without actually paying most of it is the law of Bankruptcy. To determine if Bankruptcy is right for you, please contact a local practioner.
