Legal Question in Credit and Debt Law in Maine

small claims court one spouse being sued

I'm being sued in small claims court by a bank for 700. My husband has nothing to do with this bank he has no account there. I'm the only one being sued. I am a student and mother of two. I do not work. My husband is the only income in the house. i do get money back from my student loans. Can the court make my husbands income part of the judgment? or am I considered no income? My husband doesn't want to be involved in the mess I've created. He's worried that he will end up having to go to court.

Re: small claims court one spouse being sued

A Judge would not likely consider your husband's income unless there is some fraud or misrepresentation present, or if your husband's income was part of the approval of the credit.
