Summons

I received a summons for an unpaid credit card. The credit card debt was transferred from the original company to a collection agency who then turned it over to a law office. I had been in contact with this law office and arrange to pay them so much a month. They never sent me any more correspondence unless I was a few months behind. No monthly statements or anything to show what I had paid or what I still owe. Suddenly I received a summons. I don't even believe I owe what they say due to some disaggreement with with orignal company. What should I do?

First, you need to file a written Answer with the Court within 20 days of your service or you will be Defaulted and lose the opportunity to contest the amount of the debt. Your Answer could ask the Judge for Discovery for you to request records from the Creditor. You should send this Answer and Request for records to the attorney for the Creditor. You should also go to the Maine.gov website and go to the state agency Consumer Credit Regulation. At that site there are links to additional publications that detail your rights under the law, depending upon the facts of your actual situation. You should also ask the Court for a hearing at somepoint.
