Legal Question in Criminal Law in Maine
I will soon be charged on November 14 in a court in Maine for assault (misdemeanor D). I was not arrested but this is the date of the arraignment I assume.
My question is, can I be arrested on this date? Is it a bail-hearing?
And two, it is possible to get a public defender to ask beforehand through written request, or only on this date?

It depends upon the facts of the case and the injuries, but it is unlikely that you are going to be arrested if you were sent notice to appear for the first time. Depending upon the facts, conditions of release could be set as well. It is unlikely that you would be able to get a public defender assigned prior to the court date. A private atty likely could find out what the District Attorney's office is seeking; however, it is really up to the judge.
