Legal Question in DUI Law in Maine

citation for underage drinking

Our 19 year old daughter was

PASSENGER in car pulled over by

police. Driver arrested for DUI.

Daughter admitted to police officer

that she had had an alcoholic drink.

Driver arrested, daughter given

citation. Has to appear in court - we

have no idea what to expect. Do we

need an attorney?

It is not possible to determine (from your question) whether this happened in Maine or Massachusetts. I can tell you that having an attorney is not going to be a detriment to your daughter's case. You don't want a criminal conviction, and a competent attorney will be able to look at the case and determine what defenses there may be, or just do some good negotiating with the prosecutor. It depends on what county your daughter was in, however it is never a bad decision to retain an attorney to negotiate for your daughter. The police have to see your daughter in possession of alcohol. Simply having consumed alcohol is not a crime.
