Legal Question in DUI Law in Maine

conditions of release

I was arrested for an OUI and was released on personal recognizance. My conditions of release are that I not possess or consume alcohol and that I submit to random search of myself and residence, also that i be subject to a chemical test at any time. Does this mean that no alcohol can be in my home, even if it belongs to my parents? (i still live at home with them and I am 23yrs. old)

You are correct. Any alcohol that is in the house where you live, or in the car that you are in (driving or not) will be presumed to be yours, and puts you in violation of conditions of release, which is a misdemeanor crime with additional fines and penalties, including what may be immediate incarceration. While it is unlikely that the authorities will go in your home just to see if you are in compliance, it is wise to be in compliance. Please let me know if I can represent you in this matter.
