Legal Question in Family Law in Maine

Child Support

My mom left me with guardians when I was 5. I have lived with them for 13 years. During that time my mom received child support from my dad for me. She sent it to my guardians. They put it in a bank account and always told me that when I went to college they would give me the money. It is approximately $100,000. My question is are they legally allowed to keep that money. They did support me for those years but there was never any court order for child support to be paid. Also the guardianship papers they have were for six months only. Nothing else was ever written up in regards to this. Am i entitled to that money and what steps do I need to take to retrieve it?

Re: Child Support

That's actually a very interesting set of facts. What you are describing sounds like your "guardians" (in name only) were accepting funds on your behalf. The actual child support order, I'm guessing, required payment to your mother, who then turned over the funds to the guardians on the express understanding that they were to be saved or otherwise invested for you.

Obviously, whether or not you could recover those funds, or a portion of those funds, would depend on the specific facts. Your mother would probably also want to join in any such case on your side, seeking to enforce the verbal contract that the guardians were to release the funds to you on your 18th birthday. I'd like to talk to you about it to get more details. If you're interested, please do not hesitate to contact me.
