Legal Question in Family Law in Maine
child support and taxes
My children live with me in Florida, but child support is taken out of my checks due to divorce order. I am currently filing motion to modify primary residenct and child support, as I am paying support to him although they live with me and he is named as primary residence. I claimed kids on my taxes because they lived with me for more than half the year. H&R Block was sure this would not be an issue. My ex-husband just mailed me a check for $400 and a copy of a page of divorce record stating he has the right to claim kids on his taxes as long as they primarily reside with him. He has never sent a check before. Is this a trick to get me in trouble? Should I refrain from cashing the check? I'm afraid he is trying to trap me in something. As this is his nature.

Re: child support and taxes
I don't understand what the check is for, child support, tax refund? You should consult with an attorney, or clarify the check issue with your ex-spouse and get your motion before the judge as soon as it can be heard.
